The intent and purpose of the smoke-free ordinance is to protect the public health and welfare by prohibiting smoking in enclosed public places and places of employment.
Smoking is prohibited in all buildings generally open to the public without special invitation including but not limited to buses and other means of public transit, restaurants, bars, bingo halls, bowling alleys, retail stores, health facilities, churches, theaters, aquariums, galleries, libraries, museums, sports arenas, polling places, and school buildings.
Smoking is prohibited in all enclosed areas that employees normally frequent during the course of employment. This includes, but is not limited to common work areas, auditoriums, classrooms, conference and meeting rooms, elevators, hallways, cafeterias, employee lounges, stairs, restrooms, and vehicles.
Smoking is prohibited within a distance of 20 feet of an entrance to an enclosed area.
Smoking is permitted in…
- Private residences, except when used as a licensed childcare, adult day care, or healthcare facility.
- No more than twenty-five percent (25%) of hotel and motel rooms rented to guests.
- Retail tobacco stores.
- Private and semiprivate rooms in nursing homes, retirement facilities that are occupied by one or more persons, all of whom are smokers and who have requested in writing to be in a room where smoking is permitted.
The law requires a "No Smoking" sign be posted, a written no smoking policy be available to employees and removal of all ashtrays and other paraphernalia from any
area where smoking is prohibited.
"No Smoking" signs or the international no smoking symbol must be posted by the owners or managers in every public place and place of employment.
Signs must be posted at every entrance to places clearly stating that smoking is prohibited.
Signs must be a minimum size of 20 square inches and be placed at a height of 4-6 feet above the floor.
