This Ordinance No. 2026-34 shall be referred to as the “Pueblo County Ordinance Restricting Truck and Commercial Haul Vehicle Traffic,” and may be cited and referenced as such.
C.R.S. § 43-2-110 et seq., C.R.S. § 42-4-106 et seq, C.R.S. § 43-2-135 and C.R.S. § 42-4-1071 authorizes the Board of County Commissioners to adopt ordinances to prohibit the operation of vehicles upon highways under their jurisdiction and regulate traffic on County roads and to authorize the assessment of a penalty and surcharge for the violation thereof.
For the purposes of Chapter 10.10, the following terms shall have the following meanings:
Authorized emergency vehicle means such vehicles of the Fire Department, police vehicles, ambulances, and other special-purpose vehicles as are publicly owned and operated by or for a governmental agency to protect and preserve life and property in accordance with state laws regulating emergency vehicles; said term also means such privately owned vehicles as are designated by the State motor vehicle licensing agency, necessary to the preservation of life and property, to be equipped and to operate as emergency vehicles in the manner prescribed by state law.
10.10.040 Time-of-Day Restriction — Establishment.
Commercial haul vehicles, as defined in Section 3 below, are prohibited from operating on 36th Lane between U.S. Highway 50 and South Road during the following restricted hours:
(a) 7:00 a.m. to 8:00 a.m., Monday through Thursday; and
(b) 3:00 p.m. to 4:00 p.m., Monday through Thursday.
These restrictions apply during Pueblo County School District 70 school days. Restrictions are suspended during school holidays, school breaks, and summer recess.
The following penalties shall apply to this Ordinance:
Section 5.01 The provisions of C.R.S. Section 42-4-1701 are adopted by this reference.
Section 5.02 Prosecution may be brought against a violator in accordance with C.R.S. Section 30-15-402, and under the penalty assessment procedure provided in C.R.S. Sections 42-4-1701 and Section 42-4-1703 and Sections 42-4-1708 to 42-4-1718. Such violations shall be a Traffic Infraction and, upon conviction or confession of guilt thereof, shall be punished by a fine of not more than thirty-five dollars for each separate violation, plus a surcharge of ten dollars ($10) under C.R.S. Section 42-4-1701(4)(a)(I)(F) and any applicable Court surcharges and administrative fees.
Section 5.03 Each violation of this Ordinance shall be deemed separate and distinct from any other violation of this Ordinance or of any other federal, state, or local law rule, order, or regulation.
The restrictions on operation of Commercial Haul Vehicles contained in this Ordinance shall apply to the section of 36th Lane extending South from E US HWY 50 to South Road, within the Pueblo County during the hours of 7:00 a.m. to 8:00 a.m. and 3:00 p.m. to 4:00 p.m. on any day when school is in session for Pueblo County School District 70, the use of which this County has jurisdiction and authority to regulate.
If any part or parts of this Ordinance are for any reason found to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Board hereby declares that it would have passed this Ordinance and each part or parts thereof, irrespective of the fact that any one part or parts are declared invalid.
The adoption of this Ordinance is in the best interest, safety, and welfare of the citizens of Pueblo County and visitors to Pueblo County.

It was adopted on June 18, 2026, and the Pueblo County Clerk is hereby ordered and directed to cause this Ordinance to be republished by title and with amended sections in the Pueblo Chieftain, a newspaper of general circulation in Pueblo County, Colorado, June 25, 2026, and shall take effect on (30 days from date of publication) July 25, 2026.
