Pueblo County Clerk & Recorder Outlines Recall Process for Elected Officials
Pueblo, CO – The Pueblo County Clerk & Recorder’s Office would like to inform the public about the statutory process for initiating a recall of an elected official, as outlined in the Colorado Election Code, specifically Colorado Revised Statutes §§ 1-12-101 through 1-12-123.
Under CRS § 1-12-102, any elected public officer of the state or its political subdivisions may be subject to recall by the registered electors of the jurisdiction from which the officer was elected. The recall process is a constitutional right that allows voters to hold elected officials accountable between regular elections.
To initiate a recall, proponents must first file a notice of intent to recall with the designated election official, as required by CRS § 1-12-108. This notice must include:
- The name of the officer sought to be recalled
- A statement of the grounds for recall in not more than 200 words
- The names and addresses of at least three registered electors who will represent the proponents as the recall committee.
Once the notice is approved by the Pueblo County Clerk, proponents may begin collecting signatures. The number of valid signatures required is based on a percentage of the votes cast in the last election for that office, as specified in CRS § 1-12-104. That number in this case is 16,431 valid signatures.
If the required number of valid signatures is submitted within the statutory timeframe, a recall election will be scheduled in accordance with CRS §§ 1-12-111 to 1-12-114. The election will allow voters to decide whether to remove the official from office.
